Federation of Small and Medium Enterprise Ukraine expects that the State Committee of Ukraine on Regulatory Policy and Entrepreneurship will help achieve the removal of independent trade unions on the draft Labour Code regulations, which, if their decision will lead to the deterioration of social protection of employees.
This was announced by Chairman of Federation of Small and Medium Enterprises of Ukraine Viacheslav Roi, commenting Description legislative initiative of the State Committee, deprive an employer license to a certain type of business, if he will demonstrate at least one worker without proper registration of labour relations.
"We certainly welcome the proposal by Michael Brodskiy (the head of the State Committee - UNIAN), - said V. ROI. - The state should finally begin to solve problem of shadow wages and related social vulnerability of employees in small and medium businesses. But in this connection the State Committee pay attention to the fact that the new draft Labour Code, which can be adopted by the Verkhovna Rada by the end of the current session, or at least the end of the year, contained provision that would greatly complicate the possibility of punishing the employer for such guilt : in this project recorded in 1941: "Contract in writing form may be signed at any time after the occurrence of labour relations.
According to Viacheslav Roi, such a rule could become a convenient pretext for the employer to avoid liability for violations of labour laws.
"Of course, labour relations are recorded not only the labour contract in writing form, - said V. ROI - but indicated standard draft Labour Code must be used by employers as a defense in court when he tried to take a license. We must deprive the employer of the "loopholes" and either remove this provision or to sign the labour agreement required from the first day of the employee.
"We also urge the State Committee to express their attitude to those proposed in the draft Labour Code provisions that significantly reduces, compared with the current Labour Code, the rights of trade unions" - said the Federation of Small and Medium Enterprises in Ukraine.
Earlier, the State Committee Chairman Brodskiy in Shuster Live broadcast and interview "Contracts" declared that "we write in terms of compulsory licensing provision: if the company demonstrate the employee without proper regulating labour relations firm will stay without license. After all, this employee does not pay taxes, while he is not protected by law. If something happens to him, he does not execute disability does not pay a hospital. And then he will not receive a normal pension. That's all - the dispossession of people. They are slaves. Brodskiy also urged citizens to unite in the trade unions and employers require formal employment, to provide a pension and social protection.
